Yay! Finally people pull their head of their arses! It doesn't really matter if people marry, all they're trying to do it soldify their relationship. I honestly don't know how in hell people think that gay marriage is going to "undermine the moral foundations of America".

You're confusing the legal and the moral ground here. The judge will never justify the disobediance to law based on morality: the lawmaker will have to change the law instead.
