Well not necessarily. There are plenty of conceptual reasons as to why it is "bunk", subjective prescription, determinism, the inability to see the future accordingly and conflicting free wills (of the individuals moment), among many other arguments. For a theory to deal with humans, it must deal with human nature. As a further problem to classical utilitarianism which you espouse, you have the conflicting egoisms of different individuals... deterministically not in terms of free will. More advanced utilitarian ideas solve that by analysing the term "happiness" or "welfare" and changing it to a potential state, not an actual state which is for the individual. It's similar to my distinction between freedom and choice about which I believe you are aware.
Some ideas are purely conceptual, utilitarianism is not, it is a direct prescription for the people, not a description of their state and thus a conceptual equilibrium analysed. It is the difference of working out the speed of a particular orbit with a given altitude and a planet of given mass. Utilitarianism moreover is working out the descent vector for re-entry, get the angle wrong and you're screwed. Utilitarianism assumes the wrong atmosphere, so to speak.

Army kitten-killers appeal

THREE soldiers kicked out of the army and condemned world-wide for torturing a litter of kittens during a drinking session are fighting their discharge.
The three were among six soldiers from Townsville's Lavarack Barracks who caused international outrage when they appeared in court in May charged with animal cruelty offences.
One of the three-week-old kittens was dragged behind a motorcycle then crushed with a four-wheel-drive vehicle and three others were doused with fuel and set alight.
The kittens were from the litter of a stray cat at the barracks.
Other soldiers, sickened by the Easter Saturday outrage, told the army's special investigations branch, which passed the information to civilian police.
All six soldiers – Ben Lightbody, Brett Neville, Casey Parker, Geoffrey Symonds, Darryl Llewellin and Christopher Murray – pleaded guilty and were fined $2000 but did not have convictions recorded.
Police are appealing against the leniency of the sentences. The appeal is set down for the Townsville District Court on September 3.
After an independent review, the Australian Defence Force last month announced the soldiers' behaviour had been "manifestly below the standard required" and discharged them.
"The act was appalling and the consequences of the act are dire," 3rd Brigade commander, Brigadier David Morrison, said.
They were given 28 days to lodge a "redress of grievance" to fight the discharge.
A Defence spokesman this week confirmed three of the soldiers had appealed.
Two had accepted the army's decision and left the defence forces while the discharge of the sixth soldier was on hold while he received medical treatment for an undisclosed condition.
The spokesman said he could not disclose which soldiers were fighting their discharge "for privacy reasons".
He said the Soldiers Career Management Agency was considering the appeals and it was unknown when a decision would be made.
"The purpose of the system is to provide a formal mechanism for complaints to be investigated and reviewed, and where necessary to correct wrong or unfair decisions or actions," the spokesman said in a statement.
The three soldiers remain in the army but not on active duty while their appeals are being considered.
It has been a troubled time for Lavarack Barracks, with an army captain, 27, to appear in Pormpuraaw Magistrates Court on Friday charged with shooting five stock horses on a cattle station in Cape York.
Capt Ralph Max Schweizer was on leave when the alleged incident occurred.
Earlier last month, Private Rowan Alexander Dickson, 21, was fined $350 in Townsville Magistrates Court for drug offences.
The army has issued him with a notice to show cause why he should not be discharged.

Two Australian men may be prosecuted after they chewed live mice and bit off their tails as part of a pub competition to win a holiday.
The RSPCA called the incident "outrageous" and said it would seek the maximum penalty against the men.
RSPCA chief inspector Byron Hall said they could face two years in prison and fines of A$75,000 (US$52,050).
The Brisbane hotel where the contest took place condemned it and said it would not happen again.
Mr Hall said both men put mice in their mouths and bit off their tails. One of the men went on to further chew his mouse then spat it out.
They were taking part in a "Jackass promotion" - named after a US TV stunt show - which took place on Wednesdays at the Exchange Hotel in Brisbane and involved undertaking dares, one of the hotel's managers told BBC News Online.
It was not clear who organised the promotions, but Marie Middleton said they had now been stopped.
"The whole incident was horrific," said Ms Middleton.
"It was all supposed to be harmless fun," she said, adding that the hotel had now "tightened management procedures 100%".
She said the hotel was assisting the RSPCA (Royal Society for the Prevention of Cruelty to Animals) in their investigations.
A Queensland state minister, Henry Palaszczuk, urged anyone with information to contact the RSPCA.
The winner is still being sought, while the other competitor has already been interviewed.
"Chewing a mouse and spitting it out is not entertainment, it is barbaric," said Mr Palaszczuk.
"All animals deserve respect. How we treat animals is a measure of how civilized our society is," he said.
