No court has the authority to enforce anything, sillykins. The United States Supreme Court doesn't have the authority to enforce any of its own rulings. That's why if the executive branch chooses to ignore it, then SCOTUS is powerless to stop it. That's what happened during the Civil War and Lincoln's suspension of habeas corpus.
As I said, a court's authority to enforce extends just as far as its rulings are abided by. Since ALL of the EU's Human Rights Court's rulings have thus far been abided by, then it has de facto authority in its rulings. You can't say a court whose rulings are always obeyed has no authority. Clearly, whether it is written into law or not, this court has established a jurisdiction in which its rulings are followed, which included the UK ban against gays.

the human rights court is only worth the paper its written on

Boris, I agree that it makes less of a difference when you're crawling throught the tall grass than while sitting around on base somewhere. I believe MtG said pretty much the same thing.
The point keeps that keeps coming up though, is that the integration of gays into previously overt hetero organizations such as the military have only been successful in regions of the US and in other countries that already have less hostile attitudes towards gays than are common in the USA. Interestingly, Gen. Bradley made a similar point when Truman announced forced integration of the blacks into the US military.
Do you really expect acceptance by the military in a country where gay marriages (for example) are either illegal or do not have the same legal standing as hetero marriages?
