I thought AH released some of their old PC games like Kingmaker and 3rd Reich as freeware not that long ago? Oh well, maybe I'm wrong.

You may be correct... But the problem was the link... because not all games on that site are freeware

And that's why all I did was kill the link and not add any of the usual extra "punishments"... I knew your intent was not to promote stealing software... but to offer up a way to get a game that probably is just freeware.

All abandonware sites contain mostly games the copyright owners probably wouldn't care about. But not always, and therein lies the problem.

Plus, it's hard to actually get a developer to admit a product is abandonware, even if they don't list the software as their's and haven't patched or supported it in years. If it starts making a comeback all of a sudden it's a "classic title" and they start screaming for money.

I guess the only thing to do is come to a place like this, confirm that the particular game is in the public domain, and then search out the "grey area site" and DL. Doesnt seem like a big problem if youre only doing this occasionally for that rare public domain must-have title.

I think Underdog's policy is fine: if they receive a letter from a copyright holder asking them to stop a certain game from being offered, they will oblige.

So that pretty much means that the games they have for downloading is more or less legit.

Of course, some others sites are more, uh, rogue-ish.

so if im the marketing guy at a game publisher, i have to search the net daily to see what sites have any of my titles available for dl ANYWHERE on the net, and i have to contact THEM. and if they in any way accepted that it was the publishers obligation to notify, then some other abandonware site could cite the precedent - then someone would have to define a "key" abandonware site.

Yes and no. Big sites such as the Underdogs are well known to game publishers, and they probably would try to attempt to proactively acquire permission as well.

And you cannot stop all the firesharing out there anyway, regardless whether you search the Net daily. Your best bet is to deal with the big sites squarely.

This discussion seems to come from time to time here in other games. I have my thoughts of this issue, but as long as Poly has a policy that we can't change(you know, anti-democracy), why bother bringing it up?

You are right it is not clear cut, and the policy is perfectly reasonable. I haven't said I disagreed with it.

However, I do think the site in question provides a good service without infringing anyone's rights.
