No you're not (at least not here in TN or in GA)*, but it definitely helps your case and how the potential jury will appraise your motives - remember Thorn (and PH, if he's reading this), that despite what the lawyers and judge tell the jury about sticking to the facts of the case, they will base some varying portion of their judgement upon what they think of you and your character.

*Edit: I should clarify that you can always file, but whether the judge will determine your case has merit and is worthy of the courts limited time will in most cases depend on whether you tried the non-legal route first.

The only states with gay anti-discrimination laws in private employment are:

California
Connecticut
Hawaii
Maryland
Massachusetts
Minnesota
Nevada
New Hampshire
New Jersey
New Mexico
New York
Oregon
Rhode Island
Vermont
Wisconsin

While NC doesn't have statewide laws, there are anti-discrimination laws in the major cities for public employment. The only NC city with private employment laws is Raleigh, and only for private companies who have contracts with the local government. So unless you're in Raleigh and the company had contracts with the city, you're SOL, it seems.

Actually, I don't know how up-to-date this information is--the latest date I can find on it is 2000, so things may have changed.

Am I in the right thread? Anyway, Asheville has an ordinance pertaining to gay discrimination in public employment but nothing covering private employment. North Carolina law is not kind to employees of any type.

Wrongful dismissal is quite another thing from freedom of association. I agree that he should find out if he has a case, and then take the proper procedures from there. I'm not sure why you would think that I would support his employer. Being gay should have nothing to do with his job.

That wasn't my point, my point was they just suspected it, and didn't have any proof, that's what makes it even more inflaming, as that really is the actions of bigots...

As for my BF and me in public, I try to not influence his work at all, I bite my tounge indeed. He has credit card debt, student debt, and is on finacial aid, so if something really messes up in his life he goes back to poor street and does not pass go and does not collect 200 dollars. Afterwards, I go on a rampage!
