Note I mentioned lack of supply too. And it's still a problem today. Look for some old games (like Fantasy General). You might get a used copy from someone if you send money over the web to someone on another continent. Or you can download it illegally. Will it hurt the developpers or publishers? Well, both vanished...
And CD protection is what prevents me from running my legal version of MoM on my current computer (the MoM computer died of old age a few years ago). So CD protection actually increases piracy form my point of view.
You should check Brad Wardell's opinions on the subject. He's talked about it very often (google Brad Wardell piracy and behold or check this one among others: http://draginol.joeuser.com/index.asp?aid=21895 ).
