I would also beg you to delete the thread, even at this point, as cops can change their minds in an instant and charge these things. Of course, since this has been up for a few hours now, there is probably a cached version someplace. Can't unring that bell.

You sound more like a Frenchman than a German

It is the first time I've stabbed somebody. The night's a little hazy, and I'm sure I ended up pretty lucky because I made a couple stupid decisions.

Although Mass may be the weakest link in the US, I can't imagine that rights for criminals have overcome victim's rights to this extent. You must be able to defend your life! Right?

OK first of all I only read the OP of this thread. It is very good that you are OK now first of all.

Now.. will he take it back to you? Depends. No one can say for sure. Is it possible? Absolutely. Especially if everyone goes without prison time, he might get back to you.

Now there are few fundamental things. Did he draw the knife on you. If he did, then it's OK you returned the favour. But if you found a knife in his pocket or something while you were wrestling, took it and stabbed him.. dude you might be in trouble. If not legal, then definitely he might come and return the favour especially since he knows where you live.

What is essential in these situations is to make sure the person who draws a weapon on you never survives to return the favour. In this case, it would have been pure crazy and stupid and evil, so I'm glad it didn't go that far. But in general, if someone pulls a knife on you and tries to stab you, and you get a hold of him, stab him hard, or don't stab at all. There's no half way.

Cops won't do crap for you in real life, they can't protect anyone forever, so best is to be alert for a while now and carry some self defense and if the dude attacks you, be sure to use maximum force since odds are he is not empty handed. There's just no good advices here, except to be alert, take care of yourself, and stay out of trouble.

In reality, odds are he won't come for you, and that's a fact. Most likely, the very most likely scenario is it's over now and that's it, end of story. But don't get caught off guard if something should happen in the next few weeks or so. Also try to avoid walking alone at dark few some days. And defnitely check out who is on the door before opening it, and keep something handy if it should be uninvited guests.

Great odds are nothing happens though.. but for example in here, the stabbing capital fo the world and culture of knife fighting and no jail sentences for it, biggest odds are you'd be stabbed soon. So that's why I say you better keep an eye out, and remember, if he attacks you, it'll be dangerous since you already stabbed him (I ASSUME he is alive and not lethally wounded?), he won't be coming to slap you like a girl.

the key phrase in any jurisdiction is "the individual can use reasonable or equal force to defend him/herself, another person or their property"

the facts in this matter are:
1) person 'a' gets mugged
2) person 'a' gets weapon from mugger

The key point, from a prosecution perspective is what happened next. Did the mugger try and flee? If he did and person 'a' pursued and attacked, then it is a whole new ball game. However, if the mugger continued to attack, then it remains the same process, provided reasonable force was used to defend yourself.

Exactly. If the mugger was subdued, then you can't knife him, whether in Mass. or Texas.
