Text of her letter of resignation:

It has been a great privilege indeed to have served as a member of the court for 24 terms. I will leave it with enormous respect for the integrity of the court and its role under our constitutional structure.'’


She has been the balance of the court, offsetting the radical conservatism of Scalia, Thomas, and even Rhenquist. Why she would retire now, knowing that Bush will do everything in his power to appoint a judge as conservative as possible, is beyond me. At least we will now see how honest the Republicans who agreed to the filibuster compromise actually are.

Actually... this might be the best time for her to retire. Bush is at his weakest, and probably can't get away with putting a totally conservative judge up for the job.

It will have to be somebody closer to the center.

I'm not uneasy about Bush not for this reason anyway. However, given the past record of the DNC and Moveon I'm prepared to see lots of ZOMFG Bush nominated one of teh evil conservatives to the SCOTUS! ads. And I believe the filibuster deal will collapse in the face of this "extraordinary circumstance."

She was 75... probably didn't want to die while listening to oral arguments. Would have been difficult for her to put off her retirement any further, especially if she wanted a few years away from all the hubbub before she passes on.

Oh, and Bush's approval rating means he probably won't try to nominate someone like his AG Gonzales. He's spent much of his political capital on Iraq anyway.

IIRC, her husband is really sick. I think she wants to spend her time with him in HIS last years, not hers.
