What is the general policy followed for the title artwork? Would it be "illegal" to use a downloaded gif by Boris or Brom?

Actually, according to John P. of Microprose, you can't sell your scenarios under any circumstances. Nor can you sell any other artifact created by one or altered from one of the Civ programs: maps, rules.txt, etc. Supposedly, this is covered under the license.
