Hmmmm.... Some interesting points your raise...
I could go either way on this issue.
On one hand, it is a public domain photo. The fact that you resized it and cropped it doesn't really change that. Public domain means just that... ANYBODY can do what they want with it.
Yet on the other hand, since you have used it for a long time, one could argue that your handle and avatar are synonymous and that you do have certain rights to it on these forums.
In addition, one must look at the "intent" behind its use to judge if it is being used in a way which violates forum rules. IMHO, in this case, it is not being used to Flame you, or to attack you. While it's use might irate you... I don't think it is violating any forum rules.
So you raise some valid questions. While the owners of this site have given me some flexibilty in the determination of acceptable and not acceptable avatars... I would love to hear their opinions on the subject.
Personally, I agree with you. Based on your long use of it, and the fact that everytime I see the avatar, I think you are posting.
So unless MarkG or DanQ have a different opinion, I will request that he stop using it. But not until the owners have had a chance to respond to this. Probably a day or two. And who knows, by then, the "joke" may have run it's course, and no action will even be needed.
That's my two cents worth. Any other opinions will be listened to.

I have to disagree, Ming.
Pictures cannot be moderated in this manor.
I wouldn't care if somebody used my airborne patch, nor the others I use elseware, it's the height of arrogance to claim a picture is your personal property because you used it for a bit.
Did Krazy take the picture himself?
If not, he's a hypocrit, for he's stealing someone else's work.
Freedom for all avatars, with the exceptions you mentioned, Ming, and my own disclaimer about photograpghs of members (these should only be allowed to whomever they belong too).
Thumbs down to this bit of nazism. 
Let the kitten roam free, let no person infringe on another's freedom.
I might add it's a mockery that Krazy is attempting to force not one but TWO people to bow down to him, Eli and Mr Fun.

Here's a simple solution, everyone should simply turn off avatars. I have turned them off not because of load time (cable modem) but because I don't come here to look at images, I come to read people's thoughts and ideas. Images just get in the way of that.

I'd love to get my greedy little hands on a custom avatar. I've been here for a long time (lurking much of it, true), I've been a good citizen, and if it weren't for that bizarre OT rule I'd have had enough posts ages ago...
