Mods, my rights are being violated by the unauthorised use of an avatar I created. Original picture was specifically public domain. I put work into resizing, cropping and saving as different file format. This gives me copyright on resulting image at least until I die. Mr. Fun's unauthorised use of said kitten avatar is unlawful, and your facilitation of said unauthorised use is also unlawful. I politely request that action be taken, as Mr. Fun has ignored my repeated pleas for withdrawal of his current avatar.

Hmmmm.... Some interesting points your raise...

I could go either way on this issue.

On one hand, it is a public domain photo. The fact that you resized it and cropped it doesn't really change that. Public domain means just that... ANYBODY can do what they want with it.

Yet on the other hand, since you have used it for a long time, one could argue that your handle and avatar are synonymous and that you do have certain rights to it on these forums.

In addition, one must look at the "intent" behind its use to judge if it is being used in a way which violates forum rules. IMHO, in this case, it is not being used to Flame you, or to attack you. While it's use might irate you... I don't think it is violating any forum rules.

So you raise some valid questions. While the owners of this site have given me some flexibilty in the determination of acceptable and not acceptable avatars... I would love to hear their opinions on the subject.

Personally, I agree with you. Based on your long use of it, and the fact that everytime I see the avatar, I think you are posting.

So unless MarkG or DanQ have a different opinion, I will request that he stop using it. But not until the owners have had a chance to respond to this. Probably a day or two. And who knows, by then, the "joke" may have run it's course, and no action will even be needed.

That's my two cents worth. Any other opinions will be listened to.

I have to disagree, Ming.

Pictures cannot be moderated in this manor.

I wouldn't care if somebody used my airborne patch, nor the others I use elseware, it's the height of arrogance to claim a picture is your personal property because you used it for a bit.

Did Krazy take the picture himself?

If not, he's a hypocrit, for he's stealing someone else's work.

Freedom for all avatars, with the exceptions you mentioned, Ming, and my own disclaimer about photograpghs of members (these should only be allowed to whomever they belong too).

Thumbs down to this bit of nazism.

Let the kitten roam free, let no person infringe on another's freedom.

I might add it's a mockery that Krazy is attempting to force not one but TWO people to bow down to him, Eli and Mr Fun.

I have to agree with Chriss and GP (and others) here. Those of us who don' t have the right to use custom avatars also share avatars all the time. Claiming rights on a public domain picture is silly. What if someone on CG would use this avatar? Noone could stop that... Unless avatars are making fun of or insulting people or otherwise break the site's rules, I think they should be free.

I agree with Rah ... if you really want that avatar to be yours, KrazyHorse, then why don't you stop all the childish avatar-war games (I know it isn't only you, but still...) and go back to what you had before?. If you don't want to use the avatar yourself then why do you care if somebody else uses it?

Perhaps you and the kitty avatar are so closely identified that it might be considered your property on this forum. I haven't been here very long and even I get a bit confused when I see someone else posting with it. However, if you decided to stop using it, for whatever reason, then I can't see how you can complain about anyone else using it.

I find some things to be as funny as a mass grave. IMO, having someone running around trying to make a statement by spewing Nazi and neo-Nazi images can be chalked up to 1 of 2 things. Either he is a Nazi, or he is too juvenile to understand why it is a no-no.

I suppose the debate may be irrelevant once Ming or Mark sees Mark's avatar defaced with a Swastika. A permanent dunce cap might be the 'final solution'. But then again I could be wrong.

Here's a simple solution, everyone should simply turn off avatars. I have turned them off not because of load time (cable modem) but because I don't come here to look at images, I come to read people's thoughts and ideas. Images just get in the way of that.

I'd love to get my greedy little hands on a custom avatar. I've been here for a long time (lurking much of it, true), I've been a good citizen, and if it weren't for that bizarre OT rule I'd have had enough posts ages ago...
