The common belief that if a game is no more sold or supported then its private commerce/exchange cannot harm the rights owner, alas, is not accepted by companies, and the copyright gives them a legal leverage to enforce their view.
I don't know, I'm not a lawyer, maybe it has to do with "intellectual property" rights...
or maybe the fact that someone is getting, using and enjoying their old product albeit they wouldn't be there to sell it anyway, makes them fear it wold spoil a market niche they're intentionally keeping empty... like they plan to commmercialise a new similar game which is just an eye-candy/rehash plug and they don't want to find out that it doesn't sell because also *new* customers prefer to play their old discontinued game, for free...
Most abandonware sites "claims" are indeed not sustained by law, they're indeed violating copyrights.
They dare, until a company files them a (law-backed-up) removal request...
