quote: AFAIK having an illegal party is (in Germany) more related to your first paragraph - eg. you canīt get public jobs as a member of such a party, the party cannot do anything in public (canīt participate in elections, canīt make demos etc.). It doesnīt mean that all the members end up in jail as political prisoners. The main purpose to declare a party illegal is to make sure that this party canīt participate in the political process anymore, it is not the goal to criminalize every individual member. |
that would go against our garaunteed right to the freedom of speech. it simply cannot be done with our constitution.

If thier organization as a whole was involved in criminal activity they would no longer be taken seriously as a political party and they would come under investigation by the proper authorities. Im not old enough to be familiar with the Black Pride (Panther) movement, but Im pretty sure they are an example of this

and nah... considering that when there's a KKK rally, there's three people in hoods and hundreds of protestors... there's no need to have them be illegal... if anything, their cause is harmed by it being legal as they are ridiculed so much...

Well, if the constitution says, that all people are equal, and there is a party, that says, that all Jews and Blacks are scum and need to be exterminated, this party is obviously not based on the same constitution and deserves to be outlawed, or at least to be restricted in the democratic process. |
Yes, obviously...
If the constitution said that congress may pass no law countermanding equality (by the way, it's the declaration, not the constitution that says "all men are created equal), that still would in no way mean that all people are forced to believe in equality.
Our government guarantees freedom of speech, except in circumstances where it incites immediate violence. That's part of our constitution and one of our basic rights as human beings.
