I don't see why they should have lost the first case, but once they got involed with music, they should have known they were courting a lawsuit. You can't use the same trademark and sell the same product. You can be Apple or you can sell usic. You can't do both unless you're Apple Records.

They didn't trademark an Apple. They trademarked the corporate name 'Apple' for the music business. Makes sense.

AppleCorp doesn't sell records: it makes, presses and distributes them to companies that do. If the Beatles want to make themselves look like total ****s that's their business.

I imagine there'll be some sort of settlement over this. The last case was really stupid: they sued Apple Computer because the latter sold a computer with speakers.

AppleCorps is a boutique label set up to give the Beatles more money than they were getting from Parlophone.

I can't see why Jobs and co would be worried about this - no doubt they've costed it in already. Apple Computer could easily afford to buy Apple records out anyway - they were in talks to buy Universal Music this year.

Soon the music business will be a division of the computer business anyway given digital music, so AppleCorps position will become untenable. I imagine that's why they are striking now instead of waiting for the iTMS to hit Windows.

And you know, Imran, Apple had to have the crappiest lawyers not once, but twice. The first set should've put some sort of clause in the agreement along the lines of "from this day forward, Apple Computer has the right to...", thereby eliminating any future hassles along this line.

Then they get the craptacular lawyers again who lose the speaker lawsuit. How the hell did they lose that one?

Yep, John is right. If the first judge was an idiot, there is always the Appeal.

And yeah, the first lawyers were bad, they really messed up the agreement. They should have more properly specified how far Apple could go in relating to music, if at all.

I looked around and they've been in talks over a settlement for a while now. I think Apple Corps is only suing because if they don't they lose their rights - at least that's what one commentator said.

You'd be surpised what agreements consist of these days. Every possible little thing that can happen is accounted for. It would have been obvious that at some point PCs would have sound.

An ipod is not a musical device - it is a miniature computer that has the ability to play music. The only difference is in size, processor power, etc.

They might have a case against itunes though.

iTunes is actually thing that has sparked this, from what it seems to me. It's a music service, no doubt. But, claiming the iPod isn't a musical device is just a ****ing dumb argument . It's marketed and made with music in mind. Therefore it is a musical device.

Is AppleCorps a public, or a private company? If they're private, Apple Computer may not be able to "buy them out". It depends on how Paul, Ringo, and the families of John and George feel.

I have a feeling that AppleCorp is a public corporation. For an enterprise that big, they had to have issued shares at some point to raise some money (while the Beatles may have had cash, it takes more than that to start up a business).

I cannot find any reference to it as an publicly traded company, although I have found several that imply it dosen't hold much in the way of physical assets -- apparently they pay other record companies to "press records" under their label.
