Something I really hate about our police system.......

If the police have someone under investigation and they think they did X crime, they can say "Your buddy Y already admitted to, if you admit now the penalty wont be as severe"-meanwhile buddy Y hasent said it, or hasent even talked to the police.

I have no problem with it... The police are hampered enough as it is. Any fool who talks without his lawyer around is a total moron and deserves what he gets.

If he does have a lawyer around, at least he can advise his client on the fact that they maybe lying... or provide a different POV of the situation.

Society has a moral mandate???

Read some history. Governments aren't moral. They lie, cheat and steal from their ordinary citizens all the time.

Individuals have moral standards. When enough individuals have similar moral standards those standards are (imperfectly) reflected in the justice system.

Why shouldn't the cops lie about what sort of evidence they have, etc?

Anyhow, as I understand it, in Canada a suspect is advised of the fact that the police can lie to him as soon as he is taken into custody, along with his right to a lawyer, etc.

The only things cops can't and shouldn't be allowed to lie about are the suspect's rights etc. They can't threaten to beat him senseless if he doesn't cooperate, can't tell him that he has no right to an attorney, etc.

I have no problem with the police lying to someone in custoddy. I have a problem with police lying to jurors.

It makes sense to me. Police are representatives of the State, and their role should be differentiated from that of a judge very clearly in the mind of the accused.

IIRC, the exact wording is "you have no reason to believe anything the police tell you". Which is a pretty sweet paradox...

I don't see a problem with cops lying to suspects in custody. Everyone has a right to remain silent. It's your own damn fault if you don't exercise that right.

The problem with this policy is that everyone knows it. Following that noone talks to police. Everyone knows you cant make deals with them . If you want to negotiate about less prison time for turning buddies in you have to do it with the state attorny. In effect it makes the police worthless for talking ("You gonna f uck me anyways when I talk to you, so screw yourselves"). + Some crimes may could be prevented if the criminal would be sure he could talk to the police about some ongoing crime (and get something for it in xchange), instead of having to wait for days for the state attorney.
