wanted to be polite. I have a sister younger of course that has lived in my moms house that we grew up in all of our lives since my mom is getting up there in years if she should pass on my moms idea is to put the house up and sell it and split the monies or one of us buy the other out. My sister couldnt afford to do the latter and wouldnt have a place to live.My older sibblings say good idea i say no let her have it what does any body think?

I wouldn't give her the house. You wouldn't be doing her a favor, only passing off a burden. Sometimes people don't have money because they can't handle money. She'd probably end up forgetting to pay the property taxes and having the place foreclosed on her. I would sooner sell the place and put the money into a trust for her kids or buy the place out myself (if the siblings want/need the money) and charge her rent (low rent, but at least I can rest assure that the ass won't sell the house for beer money)

The idea of low rent is good. let the money for rent go into a trust for the taxes at the end of the year. and pay them with her rent money, since the house is paid for thats all good and let her know that she and the ass need to do the upkeep as long as they live there.

I think they would want the money. Thats why the agree with my mom. Sell the house get their share i dont have the same ideas though. my younger sister is at a loss doesnt know waht to say meanwhile the plot thickens. She and the ass are gonna help pay for some building on, to help with the new kid. So that makes things a bit more complicated.

Dont know? I havent lived in the house sincei was 18 and im 35 now. I just dont think she can afford to go anywhere else. She has raised her kids onher own for ost of the time the husband doesnt have a real job and shed end up taking another job to support the kids. If you ask me kick to sob out get on with your life etc. but that doesnt solve the problem.

Its not her im worried about its her two girls. I think your idea was a good one about the rent but the issue before that is if they make changes to the house while mom is still alive what is their stake in the home. I dont care but i know my brother and other sister do.

I have a good friend who's sister was doing the same thing... Living with the parents and having babies left and right. His dad retired last year, and "kicked" her out, he couldn't stand being home all day with HER kids and HER dead beat husband. They moved out, and they help with her, but doing it all like that is not right to her or her kids.

If you want to sacrifice your share of the money in the house to help support your sister than that is up to you. Just keep in mind that for your siblings to get their money you will have to do a cash out refinancing, and I believe that when that happens the property gets reappraised for tax purposes. Meaning that you will a) have a mortgage to pay and b) taxes will be higher... rent may not be as cheap as it could be if you can find the money to pay off your siblings.

I would consult an estate attorney.

Gaaaaa... Inheritence. That's a tough nut to crack.

I guess the first thing to note is that it's your mom's property, not her children's property. Whatever she wants to do with it is her perogative. If she wants to give it away to a buddhist colony, then that should be respected. If she dies without specifying what to do with the property, then the executor of the estate has final say.

As a matter of equity, I agree with your mom and siblings. If your sis adds on to the house, that's OK, just keep the receipts, since they should do this for tax purposes anyway.

But the executor's views on this should be examined, as a matter of political influence in the family. I encouraged my mom and dad to keep the executor as they had it originally, because I knew the executor wasn't hard up for money and, if push came to shove, could make a command decision about what to do. I was concerned that some of my siblings might try to lobby the others, as in a democracy, and would hold it against the group if they didn't get their way. Instead, their potential acrimony would be directed only at the executor (who has the "authority" by virtue of being the oldest).

So i can request not to be the one in charge. Cool my mom seems to think im the most level headed and has hinted that im the one but i guess i can tell her i dont want to be. And in which case the others can hash it out and fight amongst themselves.

One possibility is to explain to your mom that the reason you don't want to be executor is because you don't want to be the bad guy when dividing up the house. Suggest to her an alternative where she specifies what to do with the house before her death. That would shield you from recriminations.

Yes this is true, i need to sit with her and tell her to be specific as possible she has lots of gold and gems (jewlery as well and i cant see my self trying to split all that up between all of the kids. not to mentin he life insurance and stuff like that. I know that she still has the jewelry my dad gave me whne he died i told her i didnt want it. All this has been good info. She travels with her bf alot and mentioned that she was going to New york soon nd wanted to make sure her things were in order.
