Ill. Gov. to Commute Death-Row Sentences

CHICAGO (AP) - Gov. George Ryan will commute the death sentences of all 156 inmates on Illinois's death row, and he has sent letters to victims' families warning them of the move, his spokesman said Saturday.

"He's been talking about this for a few days, and in only a handful of cases was he considering, for a variety of reasons, not to include (them) in the commutations," spokesman Dennis Culloton said.

"Ultimately, late yesterday, he came to the decision this was the only thing to do," Culloton said.

The governor sent overnight letters to the families of murder victims telling them he would announce during a speech Saturday that he was commuting the death sentences to life in prison.

Ryan halted the state's executions nearly three years ago after courts found that 13 death row inmates had been wrongly convicted since the state resumed capital punishment in 1977 - a period during which only 12 other inmates were executed.

Vern Fueling, whose son William was shot and killed in 1985, was outraged that the killer, sentenced to death, would now be allowed to live.

"My son is in the ground for 17 years and justice is not done," Fueling said. "This is like a mockery."

Ryan on Friday pardoned four other death row inmates, saying the men had been tortured by police into making false confessions.

A few hours later, Aaron Patterson ate his first steak dinner in 17 years, while Madison Hobley and Leroy Orange spent time with their families as free men.

Stanley Howard, the fourth man pardoned Friday, remained in prison. He had also been convicted of a separate crime for which he was still serving time.

"It's a dream come true, finally. Thank God that this day has finally come," Hobley, 42, said Friday as he left the Pontiac Correctional Center.

Orange walked out of Cook County Jail looking a bit dazed.

"Right now it feels great," said Orange, who was flanked by his two daughters.

Orange also had kind words and a message for Ryan.

"Thank you with all my heart and please do something for the remaining group on death row," he said.

Patterson echoed that sentiment when he was released from the Pontiac prison.

"It's very important that you all look into other guy's cases on death row and in (the) prison population, there are more innocent people locked up," Patterson said.

Ryan announced the pardons Friday at DePaul University in the first of two speeches capping his three-year campaign to reform the state's capital punishment system, which began when he declared a moratorium on executions in January 2000.

In his speech, Ryan condemned the state's criminal justice system for sending innocent men to prison to be executed.

"The system has failed all four men," Ryan said. "It has failed the people of this state."

Ryan said Chicago police tortured Hobley, Howard, Patterson and Orange into confessing to murders they had not committed. Each of them was on death row for at least 12 years. Orange was on death row the longest, more than 17 years.

"We have evidence from four men, who did not know each other, all getting beaten and tortured and convicted on the basis of the confessions they allegedly provide," Ryan said. "They are perfect examples of what is so terribly broken about our system. ...

"I believe a manifest injustice has occurred."

Patterson's mother, Jo Ann, said she was overwhelmed when she heard the news.

"I don't believe in miracles but this is a miracle," she said.

Ryan spread the blame in his hour-long speech, calling the state's criminal justice system "inaccurate, unjust and unable to separate the innocent from the guilty, and at times very racist."

He blamed "rogue cops," zealous prosecutors, incompetent defense lawyers and judges who rule on technicalities rather than on what is right.

He also criticized the Illinois Legislature for failing to enact his proposals to reform the death penalty system.

"What does it take? Now that we can say the number of wrongfully convicted men is 17, will that be enough?" Ryan asked.

Reaction to the pardons from death penalty supporters was swift.

Cook County State's Attorney **** Devine said the future of the four men should have been decided by the courts.

"Instead, they were ripped away from (the courts) by a man who is a pharmacist by training and a politician by trade," he said.

Devine also criticized Ryan for pardoning the men and not consulting with his office before making his decision.

"Yes the system is broken and the governor broke it today," Devine said.

Devine's office is trying determine if the pardons could be challenged, but Devine said the clemency powers for an Illinois governor are among the broadest in the country.

Ollie Dodds, whose 34-year-old daughter, Johnnie Dodds, died in an apartment fire that Hobley was convicted of setting, said she was saddened by Ryan's decision.

"I don't know how he could do it. It's a hurting thing to hear him say something like that," she said, adding that she still believes Hobley is responsible.

"He doesn't deserve to be out there."

Hobley was convicted of murder and aggravated arson in the deaths of seven people, including his wife and infant son. He contended he made a false confession after he was beaten and nearly suffocated.

Patterson, 38, claims he was tortured into falsely confessing to murder after police threatened him with a gun, beat him and tried to suffocate him in 1986. He previously turned down a deal to admit guilt and drop his claim of police torture in exchange for freedom.

Orange, 52, was sentenced to die for taking part in the stabbing of his former girlfriend, her 10-year-old son and two others. The conviction came despite Orange's description of torture and testimony that his half brother, Leonard Kidd, was the one who stabbed the victims. Kidd, also on death row, claims he too was tortured into confessing.

Howard, 40, was convicted of murder, armed robbery and rape, among other crimes. He claims he is innocent but confessed after he was handcuffed to a wall ring, beaten and choked by police in November 1984.

Wow! Alright George Ryan!

For those of you who don't know, Chicago's Area Two police district was headed by a torturer in the seventies, eighites and early ninties (before he was finally ousted). He led a team of cops that would beat, burn, suffacate, and threaten with execution any suspect they decided was guilty. More then fifty people (most Black and Hispanic) independently claimed to have been tortured at this station over the years, nine ended up on death row, 10 got life sentences. When a few of the cops were transfered to another district, claims of torture began popping up there. Elsewhere in Illinois, police officers admitted to having lied about a supposed confession, a dream that one man was supposed to have told police about a murder. He too was sentenced to death before being released.

The innocent still need to be released, but at least there's no danger of them being executed. Good job, Gov. Ryan.

Either they didn't give a damn about the community they served (Area Two - predominately white cops in a predominately Black district) or that they thought that the people were guilty and therefore undeserving of any rights (the Jenine Nicarico case).

In one case suspect was accused and convicted of killing a cop. They tore that district apart looking for him, and terrorized the whole area, violating all sorts of people's rights, people who weren't even connected with the case (breaking into people's homes without search warrants, et). There were a number of lawsuits against the city in connection with that "investigation." Don't ever shoot a Chicago cop.

How anyone can support the death penalty when it is so difficult to prove who did what is beyond me. I understand wanting revenge, but it cannot possibly be worth the lives of the wrongly convicted.

While it was in his power to do this, I also think that the people should have been given a direct or indirect vote on this.

The practical impact wrt the public is not that large. These folks will never see the outside of a prison.

Maybe so Dan, but the people of that state wanted a DP, or they wouldn't have it.

Each case should have been reviewed, don't they have appeals courts in Il?

To commute EVERY sentance is to spit in the eye of the justice code.

The eye of justice was already spat into by corrupt cops and prosecuters.

I don't know what Blagovitch's stance is on the moratorium. Ryan did what he did to did to save the lives of the wrongly convicted. Better a John Wanye Gacy should spend 100 years (he's already been executed, btw) behind bars than Aaron Paterson should die for another man's crime.

Chris: Even though I'm pro-life and don't agree with the DP, I agree that the voters should have taken another crack at it, in one form or another.

That said, presumably it was also the will of the people of Illinois that the governor should be able to pardon and commute sentences.

He's never holding public office again. He was too badly damaged by the cash-for-licenses scandal.

And no governor can legally execute prisoners that haven't been condemned (though they could arrange for certain troublesome prisoners, like George Jackson, to meet an untimely end).

BTW, the IL gov has the authority to let every prisonor walk if he wants. Ryan is also a Republican.

The highest duty of the criminal system is the impartial delaing out of Justice, not making 'the families' "feel" better. Individual have rights that supercede any election choice. The people of Illinois will still get their pound of flesh, when the state finally gets a system that can, with a much better degree of certainty, tell us that the right people are those to be killed.

I say, birng back public executions: the people want their pound of flesh, well show them what that trully means.

Unfortunately, the IL constitution doesn't allow for referendums on anything except election matters (they really outta change that). Before 9/11, there was probably a very good chance that IL voters would have agreed to do away with the DP, given how many wrongly convicted men had been set free.

That's why I said indirect. Ryan brought up a serious situation and put a moratorium on executions. This was a good move. He should have made it explicit that this was going to be decided by his successor. The candidates would have then fashioned their platform accordingly, and then there would have been a fair vote.

I think he dealt with everything after the moratorium poorly.

Wrong is wrong.

Without the rule of law, society does not exsist.

If innocent men have been convicted, the APPEALS COURTS exsist to correct this.
If they don't work, fix them, not ignore nearly 150 trial case decisions.

I also think it's time that "pardons" be removed from elected officials, this is yet another example of the misuse of this power (Clinton was another).

Not sure how Ill law works Dan, in NY, the DP has to be unanamous decision by jury, and the judge can STILL overule it.
It's NEVER automatic.

As governer, he could have ordered that all cases be reviewed, not going overboard Dan, read what the article says, he overuled 156 cases.
THAT is ignoring the trail decisions.

This was carried out by due process, Chris. It's within the governor's powers to do what he did. Your problem, therefore, is with the law.

Clinton wasn't the only one who abused his pardon power. Bush I did it when he pardoned all the people convicted with Iran-Contra.

Also, in the cases of the men who were pardoned, the court system had already failed. Judges tend to be former cops and prosecutors, and they tend to be rather biased against claims of police torture and prosecutorial misconduct, even when there's clear evidence. It took Rolando Cruz four trials for the truth to finally come out that the police had manufactured evidence against him, while another man (Brian Dugan--who killed a nurse a few miles from my childhood home home--her body was found in the abandoned car of a friend of mine) had confessed to killing the girl Cruz was accused of killing (the confession was inadmissable because it was made under hypnosis and he refused to testify in court without immunity--he was already serving a life sentence).

While I would prefer to see a politician taking a moral stand like Gov. Ryan while his career was still in play, making it a more courageous act, I applaud him for this. One step closer to ending the barbarism.

I don't think it's right that one guy trumps the will of an entire state like that. But if those men really were innocent, you really gotta wonder how many people sentenced to crimes other then death penalty are there innocently.

Who's to say it wasn't the will of most people in the state that he commute the sentences? I'd like to see what polls show in terms of how the people of Illinois feel about it.

The problem was, he asked the legislature to revise the system... make the changes needed to help protect the innocent... and they ignored him. They gave him very little choice. With the exception of the scandels (none of which happened while he was governor) hanging over his head, he was a pretty decent Governor. This, as one of his final acts is another good one.

I do wonder about that, a lot actually, BD. If Texas' numbers are anything to go by, at least as far as faulty trials for defendents goes, as many as 1/3rd of all prisoners could actually be wrongly convicted. That's just capital cases, however.

BTW, Aaron Patterson, one of the men who was pardoned, claims he never confessed even under torture. He was convicted of setting a fire on his back steps that killed his wife and children. He was the only one from the second floor who got out alive.

Indeed. For the moment anyway. It'll be interesting to see the next Governors reaction to this and whether or not such powers are moderated in future.

That power is meant to individually overturn unfair cases, not get rid of an entire punishment.

Right I had a thread on this a while back and most seemed to agree with me there are some really ****ed up problems in our justice system. If that's the amount of people who could be wrongly convicted in capital cases where the most attention is given too, the most resources are spent on, and an appeal to the highest state court is given, how inaccurate is the system on non-DP cases where less resources are spent on finding the truth?
