The problem with age limits is greater than that in laws on rape/sex. Why is it, for instance, that you're allowed to vote and do some other things only when you turn 18 (or 21 as the case may be). I know many who are so immature in their 18 years that they clearly should not be allowed to do such things, while others are mature enough at 16 to vote and do everything thinking about the consequences, the limit being just a hassle.

However, there is no way that laws can have any sort of an individualistic approach, which is their weakness. Therefore, some line has to be drawn by age, and one can only hope that it's half reasonable.

I think you can have an individualistic approach. Have some means of assessing when the girl is ready physically and psychologically and change her legal status thus, irrespective of age. You could almost call it a rite of passage and would make bat mitzvahs a helluva lot more interesting . That has the advantage of introducing risk to the would-be attacker, that girls below a reasonable age, say 16 (whereupon the rite would be irrelevant) may not be ready. I'm not saying its ideal but it's not like we are faced with an impossible situation.

You see, if a completely mature and very responsible 15 year old has sex with an 18 years old, who in court is going to prove that she is mature enough to think for herself? We even have no means to determine or prove that somehow. Yes, the people who know her well would be able to assess her maturity and mention that in court, but that's never going to happen.

If anti-sodomy laws are unconstitutionally invasive of privacy, boning licenses most definitely are. And while I (somewhat) hate to stereotype, historically teenagers have not been too responsive to rules and regulations. Leave the laws as they are. If they're unjust, I won't lose sleep over a few guys' thwarted urges to screw 14-year-olds. Oh, the tragedy...

Maybe she could decide, maybe she could not. As it stands, a minor is legally seen as unable to make a binding decision. They can't sign contracts that can be enforced. So, presumably, they are also assumed unable to make informed decisions wrt sexual intercourse.

You cannot. The law requires everyone be treated the same, and judgement calls on something like this would be subject to wildly different views and leave the whole system open to attack. You would not be able to weed out prejudices from a highly emotional issue like this and no one making the judgement call would be able to defend themselves against charges of discrimination.

In most states a minor can petition for legal adult status. Typically a motion is only heard for someone who has either graduated early or dropped out of HS and making a respectable attempt to live a mature, responsible life.

I doubt any state would grant it for a 13 or 14 year old.

I'd agree completely. Raping a baby and having consensual sex with a 14 year old are completely different things though.

Adults having sex with 13 or 14 year old girls pushes the envelope on "consensual". The relationship would almost certainly be so unbalanced that it would be very difficult to view it as anything other than abuse.

In Canada-- not guilty-- if you took reasonable steps to ascertain the age


(4) It is not a defence to a charge under section 151 or 152, subsection 160(3) or 173(2), or section 271, 272 or 273 that the accused believed that the complainant was fourteen years of age or more at the time the offence is alleged to have been committed unless the accused took all reasonable steps to ascertain the age of the complainant.

So what is "reasonable"?


I believe the courts have allowed the simple "she looked old enough" defence ( ie really took no steps) a few times when meeting a girl in a bar and where there was no reason to lead you to believe she was under the age of 14. The courts have had a lot less sympathy with guys in circumstances where there should be any doubt as to the age of the woman in question. Big tip .. . if she mentions her junior prom, you might want to see some ID.


A defence lawyer freind of mine said he figured his client would be acquitted when he placed the "victim" on the stand dressed as she was the night she seduced the guy at a bar. He KNEW he would be acquitted when he asked the "victim" why she had never said anything to anyone ( complaint was laid by her parents once the rumour mill got back to them) and she responded that "Joe was the best lay I ever had".

I would disagree. If the adult has abused his position of power (teacher, godparent, or some such) then sure, but I don't see why 14 year olds nowadays are not capable of deciding for themselves. I'd go less far than calling for the age of consent to be reduced to 12, as was the recommendation of a study I saw recently (something my mum brought home from work at the police, have no online link) but I think reducing it to 14 would be sensible.
