In Canada-- not guilty-- if you took reasonable steps to ascertain the age
(4) It is not a defence to a charge under section 151 or 152, subsection 160(3) or 173(2), or section 271, 272 or 273 that the accused believed that the complainant was fourteen years of age or more at the time the offence is alleged to have been committed unless the accused took all reasonable steps to ascertain the age of the complainant.
So what is "reasonable"?
I believe the courts have allowed the simple "she looked old enough" defence ( ie really took no steps) a few times when meeting a girl in a bar and where there was no reason to lead you to believe she was under the age of 14. The courts have had a lot less sympathy with guys in circumstances where there should be any doubt as to the age of the woman in question. Big tip .. . if she mentions her junior prom, you might want to see some ID.
A defence lawyer freind of mine said he figured his client would be acquitted when he placed the "victim" on the stand dressed as she was the night she seduced the guy at a bar. He KNEW he would be acquitted when he asked the "victim" why she had never said anything to anyone ( complaint was laid by her parents once the rumour mill got back to them) and she responded that "Joe was the best lay I ever had".
