I expect this lower court decision to be overturned at some point, and the lower courts know this, so they just want to have their opinion made known before the case goes to the Supreme court.

Call me when the case reaches there and we have a decision. Then we can tall about the partial birth abortion ban being successfully overturned.

Nothing is overturned until the judicial process has finished.

Three courts so far -- New York, San Francisco, and the most recent one being in that bastion of leftist radicalism, Lincoln, Nebraska. As far as I know, those are the three highest courts that have ruled on the issue so far.

Which is the point in question. It seems to me that a ban on partial birth abortions would be constitutional, since R v Wade did not provide any right to abortion beyond the point of viability.
