A US judge has ruled that a feeding tube may be removed from a brain-damaged woman despite a Senate move to stop it.

Earlier on Friday, the Senate ordered Terri Schiavo to appear before a committee in the hope that by doing so, it would stop her feeding tube from being withdrawn.

But a Florida judge has re-instated an order for life support to be removed.

The latest tussle over Mrs Schiavo follows years of court battles.

Mrs Schiavo's parents want to keep her alive, and her husband, who is her legal guardian, does not.

Mrs Schiavo, 41, has been in a persistent vegetative state since 1990, and is not expected to recover.

Michael Schiavo says his wife would not want to be kept alive in her current condition.

Congressional orders

The Senate had intervened earlier on Friday by issuing subpoenas ordering Mr and Mrs Schiavo to testify later this month.



Senate Majority leader Bill Frist said in a statement the move was intended to keep her alive.

"The Senate and House remain dedicated to saving Terri Schiavo's life," the statement on his website said.

He added that US law made it a crime "to obstruct or impede a witness' attendance".

A lawyer working with Mr Schiavo disputed the Senate's power to force a delay.

"This is clearly an effort to circumvent a lawful court order by a state judge," Howard Simon of the American Civil Liberties Union said, the Associated Press reported.

"I am not sure how a subpoena, which is ordinarily done to produce records or somebody to testify, can essentially have the effect of an injunction overriding the orders of a court."

The Florida hospice where Mrs Schiavo lives said it had received a subpoena on Friday, but did not say who it was for or how they would respond.

Court battles

Florida courts have so far rejected efforts by the parents to stop the feeding tube from being removed.

And the US Supreme Court has refused to step in to rule on a fresh appeal from her parents to intervene in the case.

Even if the tube is removed, Mrs Schiavo will not die immediately, but she would be deprived of food.

The case has galvanised activists from both sides of the euthanasia debate.

President George W Bush said the case of Terri Schiavo raised complex issues.

"Yet in instances like this one, where there are serious questions and substantial doubts, our society, our laws and our courts should have a presumption in favour of life," Mr Bush said.

Mrs Schiavo suffered brain damage after her heart stopped because of a chemical imbalance believed to have been brought on by an eating disorder.

Republicans from Wyoming were trying to stop this. It's none of their business.

Although I still don't like the husband pulling the plug. I'm not sure if we can trust this guy.

oh well. sad case all the way around.

I trust him fully. I don't trust the scheming, ******* family of the woman who is trying to make the husband look bad when he's spent over a million on the wife's medical care.

the thing is husbands come and go. Marriage doesn't mean **** anymore.

The family has more right to say what's good for her than her husband. They are related by blood.

Having said that, if the family wants to keep her alive, they should pay for it .

Well I applaud the husband for trying to follow the wishes of his wife.

While I agree politics dont need to be involved here, the woman still has a family besides her husband. It may be a last ditch effort on their part but why take that away from them?

I don't think it's about the bill to keep her alive. I would wager the parents would be more than willing to cover the bill or some right-to-life organization.

He may truly care for his wife and believe she is suffering in this state she is in. Maybe she did tell him she didn't want to live like that before this happened.
Or maybe he doesn't want to be married to a vegetable forever and the term widower who remained faithful is more marketable than divorcee who couldn't wait for his vegetable wife to die. Even IF a divorce didn't cost him to lose anything financially, the media would rip him apart for a divorce or even a seperation over this.

Edit: changed widow to widower, since I doubt he will get a sex change.

It has been to this man's detriment to fight to let his wife die. If he simply wanted the money, well that was used up in care for her a decade ago. If he simeply wanted to be free, he could have turned her over to her parents' care and divorced her. Either he really hates her and wants her to die or he really loves her, and wants her to die. Of the two, only love would carry you through what this man has been through.

All this is is a way for the GOP to stir up their base.

Another thing. What about the so called "sanctity of marriage"? This part isn't to you Mrs. Tubes, but for the so called pro-lifers. The GOP always talks about how marriage is a sacred institution and how we can't let gays get married... but what about the sanctity of the Schiavo marriage? Michael Schiavo has stood by his wife for 16 years, watching her suffer in this state. Even the courts say he has the right to make this decision. It's just more proof that Republicans don't care about the "sanctity" of marriage...
