"Just once, we need an elected official to stand up to a clearly incorrect ruling by a court. Any incorrect ruling will do, but my vote is for a state court that has ordered a disabled woman to be starved to death at the request of her adulterous husband.

Florida state court judge George Greer –- last heard from when he denied an order of protection to a woman weeks before her husband stabbed her to death — determined that Terri would have wanted to be starved to death based on the testimony of her husband, who was then living with another woman. (The judge also took judicial notice of the positions of O.J. Simpson, Scott Peterson and Robert Blake.) The husband also happened to be the only person present when the oxygen was cut off to Terri's brain in the first place. He now has two children with another woman.

Greer has refused to order the most basic medical tests for brain damage before condemning a woman to death. Despite all those years of important, searching litigation we keep hearing about, Terri has yet to receive either an MRI or a PET scan — although she may be allowed to join a support group for women whose husbands are trying to kill them.

Greer has cut off the legal rights of Terri's real family and made her husband (now with a different family) her sole guardian, citing as precedent the landmark "Fox v. Henhouse" ruling of 1893. Throughout the process that would result in her death sentence, Terri was never permitted her own legal counsel. Evidently, they were all tied up defending the right to life of child-molesting murderers.

Given the country's fetishism about court rulings, this may be a rash assumption, but I presume if Greer had ordered that Terri Schiavo be shot at her husband's request — a more humane death, by the way — the whole country would not sit idly by, claiming to be bound by the court's ruling because of the "rule of law" and "federalism." President Bush would order the FBI to protect her and Gov. Bush would send in the state police.

What was supposed to be the "least dangerous" branch has become the most dangerous — literally to the point of ordering an innocent American woman to die, and willfully disregarding congressional subpoenas. They can't be stopped — solely because the entire country has agreed to treat the pronouncements of former ambulance-chasers as the word of God. The only power courts have is that everyone jumps when they say "jump." (Also, people seem a little intimidated by the black robes. From now on we should make all judges wear lime-green leisure suits.)

President Andrew Jackson is supposed to have said of a Supreme Court ruling he opposed: "Well, John Marshall has made his decision, now let him enforce it." The court's ruling was ignored. And yet, somehow, the republic survived.

If Gov. Jeb Bush doesn't say something similar to the Florida courts that have ordered Terri Schiavo to die, he'll be the second Republican governor disgraced by the illiterate ramblings of a state judiciary. Gov. Mitt Romney will never recover from his acquiescence to the Massachusetts Supreme Court's miraculous discovery of a right to gay marriage. Neither will Gov. Bush if he doesn't stop the torture and murder of Terri Schiavo."

"I have not seen any means by which the executive branch can get involved. My legal counsel has talked to the Schindler family and their lawyer over the weekend," Bush said. "My heart is broken about this."

Neither Schiavo's parents nor her husband offered new, specific details on her condition, but one of the two priests who visited her hospital room Easter Sunday said the brain-damaged woman's "death is imminent."

O'Donnell said Schiavo smiled, raised her hands and made guttural sounds late Sunday while being visited by her father and a friend, who was talking about how she liked to go out dancing.

Let us assume that is true. If that is the case, doesn't that blow out of the water the whole contention that Michael is doing this for money? Imran - I already tried that one before, even referencing Occam's razor - Ned must have been exposed to that reference. However, he and those claiming Mr. Schiavo's ill intentions refuse, categorically, to deal with that inconsistancy. "Let's see, I'm in it for the money, her money is down below $600,000 - I can take the one million and let the Schindler's have the under $600,000. Nope, I'm taking the $600,000 sounds like a better deal."

I've stated multiple times, this sadly sounds like a case where you have in-laws falling out, i.e. people related through a marraige, and over the individual linking them. That is one of the most vicious disagreements you can get into. I think sadly that it has taken on a life of it's own, and from the fact the Schindler's are now challenging Michael's funeral arrangements - I kid you not - I submit there is some credence to my theory. By the way, Michael is having her cremated and married with his family in I think it was Wisconsin, the Schindler's want her to receive Catholic funeral rites and to be buried in Florida.

oh - and for all of you Terri Schiavo is not in a vegetable - nobody has replied to my question about the status of a human brain after a minimum of 10, and maybe as many as 14 minutes with no blood circulation under normal temperature situations.

"Approximately 10,000 to 25,000 adults and 6,000 to 10,000 children in the United States are diagnosed as being in the persistent vegetative state," the Multi-Society Task Force on Persistent Vegetative State says in its 1995 guidelines on the condition, the latest available.

"Survival beyond 10 years is unusual. The chance for survival of greater than 15 years is approximately 1 in 15,000 to 1 in 75,000," it adds.

While most neurologists agree that recovery is almost impossible, the decision on whether and how long to keep such a patient alive is usually left to the individual doctor and the patient's guardian.

Schiavo has been in the condition, which is far more severe than a coma, since she had a heart attack in 1990 that deprived her brain of oxygen. Under the medical definition, that became a permanent state after a month.

Her husband and legal guardian, Michael Schiavo, has fought to allow her to die and courts have supported him.

The tube was removed on Friday after Florida courts rejected numerous last-ditch legal attempts by the parents, Bob and Mary Schindler, to keep their daughter alive. But early in the hours of Monday morning President George W. Bush signed a bill allowing federal courts to again intervene in the matter.

The Schindlers believe their daughter responds to them and her condition could improve with treatment. Tennessee Sen. Bill Frist, a surgeon and Senate majority leader, has viewed videotapes and agrees.

But Dr. Ronald Cranford, a neurologist and bioethicist at the University of Minnesota Medical School, said reflexes can fool non-specialists.

"To the families and loved ones, and to inexperienced health care professionals, PVS patients often look fairly 'normal,'" Cranford said in a statement.

"Their eyes are open and moving about during the periods of wakefulness that alternate with periods of sleep; there may be spontaneous movements of the arms and legs, and at times these patients appear to smile, grimace, laugh, utter guttural sounds, groan and moan, and manifest other facial expressions and sounds that appear to reflect cognitive functions and emotions, especially in the eyes of the family."

Such patients can even squeeze a hand in response to a caress, Swedish Covenant Hospital in Chicago says in guidance posted on its Internet Web site.

"Sadly, these actions often appear meaningful to hopeful families but are all automatic reflexes -- not movements with a purpose," it reads.

"There are no confirmed reports of anyone fully recovering from a permanent vegetative state lasting more than three months."

This is because in such patients, the cerebral cortex has been destroyed, said Dr. Lawrence Schneiderman, a physician and bioethicist at the University of California, San Diego.

"Four to six minutes of anoxia, lack of oxygen, destroys that completely," Schneiderman wrote in comments posted on the Internet at http://seeingthedifference.berkeley...neiderman.html.

"The rest of your brain, particularly the brain stem, can survive for fifteen or twenty minutes without oxygen," added Schneiderman, who signed a friend of the court brief in July of last year supporting Michael Schiavo.

"What happens is that that part of the brain, the cerebral cortex, which is us, our personality, who we are, how we think -- our capacity to experience, see, hear, think, emote -- that may be permanently destroyed."

Experts say Terri Schiavo would experience no discomfort if allowed to die, as the part of her brain that experiences pain is unlikely to be functioning.

actually I think the whole reason for this mess is Michael Schiavo did not give the money to the Schindlers he promised them.

As I've said all along, this is about money.

Becaue he didn't share teh malpractice money, the Schindlers are determined that he not profit in any way from this. And they just want to spite him.

Why do I say this? Because they were best of friends before that point. Michael actually lived with the Schindlers (even after the accident). They encouraged him to go out and meet women to get over it.

The evidence is clear. The religious right just can't admit it. How else can you explain the difference of opinion that happened as soon as Michael Schiavo denied the Schindlers the money he promised them?

Don't get me wrong, Michael is a scumbag for not giving the Schindlers any of that $300,000. But that doesn't change the condition Terri is in. She's a vegetable with no hope of recovery.

To get a clue on the money michael won- according to a very good NYT piece, MIcheal won 750,000 to pay for the care of his wife, and he himself won 300,000 for lost wages and so forth.

How many times do I have to point out that Michael Schiavo has been trying to let Terri die for over 10 years and that there was a very substantial amount of money in the trust fund for him to inherit until recently? Just because the money is mostly gone now doesn't mean that this was always the case.

Again, why do you keep ignoring the fact that Michael Schiavo can't just give up custody anymore? Things are out of his hands and have been ever since he petitioned Judge Greer to decide Terri's fate. The court controls Terri Schiavo now and they're the ones who ordered her feeding tube removed.

PVS is a subjective diagnosis. An autopsy will let us know the true extent of her brain damage was, but it will do nothing to reveal whether she was in a PVS or not. Hard to subjectively judge her responses to external stimuli when she's dead...

An MRI (or PET) would've let us know the true extent of her brain damage before she died. Doesn't do much to help her condition if we don't get that information until she's dead, does it?

And I never claimed an MRI would have any bearing on the debate over whether she's in a PVS or not.

The autopsy will determine the extent of her brain damage and show just what chance of recovery there ever was. From your response, obviously being proven wrong by the direct evidence will do nothing. Well, what more could be expected?

If you look at her CAT scan and the cat scan of a normal person, there is no doubt in the viewers mind that the majority of her brain is gone. Your blathering about this is really stupid, and I genuinely mean that. Anyone with a modecum of medical knowledge can look at her CAT scan and say, there's no brain there. A PET or MRI cannot show greater detail of something that doesn't exist.

Chance of recovery is irrelevant to the issue at hand, at least when using the standard set by the Cruzan case. The two relevant factors are whether she is an a PVS now and whether it is clear that she would wish to be killed in this situation. The latter is more in question than the former, IMO at least, but neither is completely settled.

Then a PVS isn't a subjective definition. This is one of those things that doctors can know with pretty much certainty. There isn't a lot of debate about it, except when you get doctors who put politics or sliminess before the truth, like one of the Schindler's doctors who claimed he was a Noble Prize winner. When an EEG show no brain activity for that part of the brain, and when any of the internal imaging technologies shows the organ is missing, there is no subjectiveness to the diagnosis. You just want to play poltiics, and so you're grasping at things that sound smart but show you as a fool.

It's a judgement on whether a person has any cognitive function or not. Unless you can point me to the test for cognitive function, it's obviously a subjective diagnosis. Note "diagnosis", not "definition"...
