Incidentally, I'm of the mindset that if they're firing on those that help them, we can cease to help. They obviously have the right to bear arms and have a right to self-determination.

I'm all for helping people. When they bite the hand that feeds them, though, like a rabid dog, there are a few solutions; the humane thing is to go in and put them down, but I've always found that to be a bit too costly when compared to unprecedented expenses with trying to rehabilitate the city. The better solution is to, like a rabid animal, lock them up in a place where they cannot harm others--and leave them to die. Sure, an animal dying of rabies dies a horrible death, but by the time they bite their helpers, they're too far gone to know friend from foe.
These people, if they did fire upon their rescuers, are too far gone to know friend from foe. Let them die.

The problem is that LA constitution and law has no concept of martial law. So do you break the rule of law in order to declare martial law?

I would urge a bit of caution in reacting to some of these stories. Both CNN and MSNBC reported that at least some of the instances of "firing at choppers" involved individuals firing guns in the air and demanding that guardsmen take their families on board. It's not desirable behaviour, to say the least, but it's a long way from shooting AT choppers. Who can say what we would do if our kids were extremely ill? There may well be other, more malicious attacks, but rumors are just running wild right now.
Another example is the "wild and lawless" Convention Center. This evening I saw very disturbing footage from an MSNBC cameraman who visted it today. Some 15,000 people were directed to take refuge there and yet there's not a single representative of local government on the scene (contrast this with the relatively heavy presence at the Superdome). Not a single bus has come to get them, and all the people looked to be orderly, yet extremely tired and scared. The cameraman reported that he personally witnessed to old men die on the steps (he guessed heat, but who knows), and there were women with dead babies in their arms. He insisted that during the few hours he toured the scene that he spotted no weapons, just honest, decent folks abandoned and forgotten.
My natural instinct with any news story is to doubt and look for agendas....but this was difficult to accept as anything other than face value.
Let's pray that rumors of violence don't doom these people.

Good point Kull.
These people were left behind. Those that sought shelter in the Superdome were given nothing to eat, and were held there like they were in prison. They had no information about what was happening. So using guns to signal helicopters for rescue might seem like a good idea. Or set a building on fire and hope the fire department comes so they can get out. Some are looting, but are they looking for supplies or just trying to stay alive?
