You missed the point. Putting out any number with malicious intent is wrong. Whether it's listed or not is completely irrelevant. Unlisting a number just makes it harder to carry out malicious intent.

So - Carlson's defense cannot be that Fox's number was listed and his was not. This is not complicated.

Carlson, individualy and spontaneously, acting like an unprofessional jackass isn't in the same league as the Fox organization taking it's time as to how to proceed and deciding to escalate. One would assume it's not just a lowly unauthorized web content staff puke, especially since they kept it on the website.

"But he started it" is a horseshit argument for first graders. Both should act like professionals. And if individuals fail to do so, that's why they have editors and other sorts of managerial types to step in and retain some organizational professionalism.

Besides, think it through. Fox sues Carlson, Carlson fires a counter complaint, on the more salient grounds that his home life was messed up because of Fox's irresponsibility (there has to be a law somewhere). End result is that Fox is forced to pay a settlement or face a charge that they aggrevated harassament of Carlson. It's best if both parties don't bring it to the court, but Carlson will still be marginally better off even if Fox is that immature.
