California state law:

Notice the bold part. Laws that state anything about corporeal punishment are similar to that one, in using subjective terms such as "(un)justifiable", "(un)reasonable", etc. These are always open for interpretation by lawyers, jurors, judges, etc. So if a case is taken to court, then it may easily revolve around whether the specific corporeal punishment was "reasonable". Or here, specifically, whether punishment that caused these specific injuries that required a cast on an arm, etc., was reasonable under the circumstances.

There was one other part that might not have made it to the article i posted and that being the princples saying that at this school, uses old school discpline they wear uniforms and have to be tucked in, no kissing of any kind allowed, and boys are instructed to open doors and pull out the chairs of the female peers. what do you think of that?

I think if they force that kind of attitude, they should be teaching the women home-ec instead of calculus, to be consistent.

all the rules make sense except for the holding doors and pulling chairs for females. That's just sexist.

And if i didnt mention it earlier this is the only school in bexar county which is all of sa to allow such punishment. and that 23 other states allow this type of punisment .

This is where i agree with you. there shouldnt be any rules to where the man ha to throw himself over a puddle of water to save the weak female. These gestures if demanded should be for all students.

Here is another point a law professor states that an educator can use corporal punishment w/o age rstriction to further the purpose or maintain discpline. Now thats just crap. had one of my nursing instructers slapped me for arguing with another student well lets just say we would both be in jail. What kinda law is this?

Exactly. It is a sad comment on our culture that we get upset when an 18-year-old is beaten, but wouldn't care if the person was 17, or 12, or 8. Defenders of the current system claim it is for kid's best interest, and the list of laws denying them freedom and equality are for their protection.

How can anyone stand behind that farce when the law allows beatings of children, but not adults? Sending someone to the hospital is for their protection?

This may being giving my age away not that i care i love being the old age of 35 But i remember when i was in elementary school paddleing was legal then i also remember if you got into a fight at school the harshest thing done was detention hall or suspension.

Every so often I am confronted with the sad reality that it is not a fading peculiarity, but for many youth a constant, brutal reminder of the oppressive society we live in.

This article prompted me to address the subject. What is striking about it is the victim of this paddling happened to be an 18-year-old student - legally an adult. After a paddling that landed the young woman in the hospital, she is suing the school. This statement by her lawyer bothers me:

"This case is not about a crusade against corporal punishment," said Dan Hargove, her attorney. "It's not a crusade against charter schools. ... This case is about three adults holding down an adult female and beating her with a wooden paddle so bad that she ended up in the hospital."


Why is it any less of a crime if three adults hold down an 8-year-old girl and beat her with a wooden paddle so bad she ends up in the hospital? Or a 13-year-old or 17-year-old?

Forgive me if I wander, but this issue gets me so mad I can't think straight at times.

Our system of preferential treatment of adults is of no protection and no worth to youth. It creates a class of voiceless victims to brutality. The law protects this young woman because she is 18. The law has no protection for her 17-year-old classmates. They have no recourse, and no newspaper prints articles involving the brutal beatings they suffer.

Next time a person claims the current system of age restrictions is done out of love for children, and for their own protection, show them pictures of the brused and bloody victims of that protection. Those who suffer physical punishment of such form are not safe. Those who have no legal recourse to stop it are not safe. Those whose lives exist entirely in the hands of adult authorities who justify violence in the name of love are not safe.

It is often said we in the youth rights movement pretend young people and adults are the same in every way and ignore real differences between the classes. I am not one to pretend no differences exist. Children on average are physically smaller, physically weaker, and less able to defend themselves than adults. Why then do our laws protect the bigger stronger adults from violent beatings and not those in most need of that protection?

I have stated here that i dont care how old you are the paddeling is just wrong. I in this case just as i would have been outraged if the person would have been younger, wonder why the the person inflicting the blows wasnt arrested.
