Our army should be on the border with Mexico not all the way in Iraq. You would not believe how many people sneak in through inadequate border protection. I used to live in Texas and visited Big Bend National Park and witnessed two families cross illegally within 10 a minute time period.

I know they come to America for a better life and to make more money but they should be forced to apply for citizenship and legal status just like everybody else who comes to the US.

the reason why the army is not on the border is because we aren't a police state.

It's why we don't have the army in law enforcement. Many people complain about SWAT teams because they are too militarisitic.

Yeah kinda. The circumstances should be considered. The guy is a soldier, he was at the border and a bunch of spanish speaking folks wandered up out of the night...I'd have done the same thing.

Detention until someone can straighten it out doesn't seem too harsh. Not the end of the world.

Again, they are all victims of a system that is horrible, making criminals out of the innocent.

If anything, his status as a soldier should make his treatment more severe. He should know better. Soldiers have no special right to law enforcement in the US.

He saw a bunch of guys speaking spanish? So did I, in New Mexico. And they were legal. The Spanish-speaking population of legal residents in a lot of parts of the Southwest is enormous. You're claiming that they're liable to have a gun waved at them by every ******* they run across and that the law won't protect them from such assaults? **** that. And if you'd done the same thing I'd support sending your ass to the clink too. Break the law, go to jail. Waving a gun at somebody is breaking the law. Now he gets to deal with the consequences of his actions.

False imprisonment is a crime. Menacing is a crime. Assault with a deadly weapon is a crime.

Depends upon the state. In California we have a seporate charge named "brandishing a firearm". Assualt means you must actually make violent physical contact.

I think it's pretty drastic using Minutemen to guard the US-Mexican border. I mean just one of those things could wipe out all of Mexico's major cities, but what about the fallout? The winds blow northward too you know. Do you want a bunch of Strontium 90 in your Wheaties?

Charges against Haab to be dropped. Their reasoning being that it was obvious that the 7th guy was participating in Human Smuggling which is a crime.

Others have argued that a major problem in stopping the flow of illegals is that crime is only a misdemeanor. Most cities in the US even instruct their cops not to inquire or or arrest illegals. They would have to change this policy if the crime was a felony.

But don't hold your breath. Both national parties favor illegal immigration for their own reasons. It is only the taxpayers in affected states that are complaining that illegals are destroying their state goverments.

Yeah, any brown people speaking that spic lingo near the border are definitely suspicious. They oughta stay up near Canada where they belong.

As a private citizen, absent knowledge of a crime being committed, you have no right to forcibly detain anyone. Besides, explain how one individual "arrested" and detained eight individuals without threat of force?

Actually, technically that's the battery part. Assault merely means the attempt to inflict harm, whether you connect or not, so taking a swing and missing counts.

I had a misguided gentleman attempt this once, with car keys and his fist. He missed both times, probably something to do with his nuts and trachea accidentally bumping into things and his face colliding with the sidewalk. When the dustup was settled out by the cops, he was arrested for assault, although the only contact he made with me was soft tissue colliding with my foot, knee and fists.
