The decision angered Italy's justice minister but delighted Muslim activists, who accused Fallaci of inciting religious hatred in her 2004 work "La Forza della Ragione" (The Force of Reason).

Fallaci lives in New York and has regularly provoked the wrath of Muslims with her outspoken criticism of Islam following the Sept. 11, 2001, attacks on U.S. cities.

In "La Forza della Ragione," Fallaci wrote that terrorists had killed 6,000 people over the past 20 years in the name of the Koran and said the Islamic faith "sows hatred in the place of love and slavery in the place of freedom."

State prosecutors originally dismissed accusations of defamation from an Italian Muslim organization, and said Fallaci should not stand trial because she was merely exercising her right to freedom of speech.

But a preliminary judge in the northern Italian city of Bergamo, Armando Grasso, rejected the prosecutors advice at a hearing on Tuesday and said Fallaci should be indicted.

Grasso's ruling homed in on 18 sentences in the book, saying some of Fallaci's words were "without doubt offensive to Islam and to those who practice that religious faith."

MUSLIMS HAIL DECISION

Adel Smith, a high-profile Muslim activist who brought the original law suit, hailed the decision.

"It is the first time a judge has ordered a trial for defamation of the Islamic faith," he told reporters. "But this isn't just about defamation. We would also like (the court) to recognize that this is an incitement to religious hatred."

Justice Minister Roberto Castelli, who has a prickly relationship with the Italian judiciary, said the ruling represented an attack on freedom of expression.

"In Europe we are seeing the birth of a movement that is looking to silence those who don't follow a single mindset, within which it is forbidden to speak ill of Islam, of homosexuals or of the children of homosexuals," Castelli was quoted as saying in an interview with Radio Padania.

"In Fallaci's book there is very strong criticism but not defamation," Italian news agency ANSA quoted him as saying.

There was no immediate comment from Fallaci who is in her 70s and suffers from cancer.

Just weeks after the Sept. 11 attacks, Fallaci published "La Rabbia e l'Orgoglio" ("The Rage and the Pride"), in which she said the West was superior to Islamic society and complained that Muslim immigrants had "multiplied like rats."

The book sold more than one million copies in Italy and at least 500,000 elsewhere in Europe.

Fallaci received numerous death threats following its launch and "La Forza della Ragione" was billed as her response to the outpouring of anger.

No date was set for the opening of the defamation trial.

But doesn't a defamation charge have to be untrue for it to be defaming?

I don't know what the standards are in Italy/the EU. Perhaps they're lower than here in the States.

This is pretty stupid. This is how it goes. Someone says that TERRORISTS have killed over 6000 people in two decades. Now, some activists claim this is defamantion? I'm sorry, how is this anti-anything? To this activist I could definitely say STFU terrorist defending jerk! I mean if you say, terrorists are responsible for these and these killings, how are you promoting hatred of anything, except in the minds of the terrorist lovers?

This is just STUPID. And soon, the moderate conservatives of the Coalition of East will make a statement where the writer can be killed and should be killed and it's cool and you win a prize if you do.

And our response to that is? Silence. Say something and you're a racist. Say something, and you'll be ****ing someones freedom of speech. EVERYONES freedom of speech is protected, EXCEPT the ones who actually speak something that is TRUE in the name of PC. Hey if it sounds kidn of bad in our open society, don't say it. We know it, but don't say it, someone might come and exercize their freedom of speech to judge you dead man walking. Screw that.

Saying that Western civilization is superior to Islamic civilization is not true. Neither is superior to the other.

HOw does the Italian system of courts work? Could not the prosecutors office challange the ruling to a higher court and get it reversed?

in all civilized countries there is a part of the law which explicitly defends the "religious feeling" of people. if one can establish that this is offended then the law has the power to demand restitutions.
people shouldnt get all holier than thou about these things. what is unimportant to one is important to the other. anyway law systems do recognize the right of a person not to have his religious feeling trembled upon. and at the other end is the freedom of speech, so there has to be a balance that will take into account the social paramteres of the issue as well.

I don't think we have such laws in the US. Indeed, my definition of civilization would explicitly rule out such laws.

I am inclined to agree with you to a certain extent, but it's important in situations like this not to thinks in absolutes; after all, it's all relative. I find the practice of polygamy in Islamic society to be immoral, wrong and demeaning to women, while they would no doubt say the same things about the way women dress in the West.

I got the impression from the article that she was being charged for inciting religious hatred, not for defaming Islam, which makes it a bit less sensationalist in my view. Having not read the book, I can't judge, but if the book was written with the specific purpose of engendering hate towards Muslims in Italy, then she should be held accountable. If not, then the court shouldn't be wasting it's time. However, it's a fine line to decide what falls into the realm of free speech and is acceptable criticism, and what isn't. Unless she's calling for people directly to go out and murder Muslims, or saying killing Muslims is good, I think she'll get off.

Reasons as to why this is a positive development: by bringing this woman to court Italy will be showing that people should not be targetted because of their relgious beliefs. Muslim activists will have no reason to protest when we start rounding up rogue imams that are inciting hatred against Christians and Jews in their mosques.

It might be condemnable, but why would it be against the law? It's her opinion. She is free to express her opinion. It doesn't matter if it sows hate. The only correct prohibition to my mind is if it immediately causes violence. What she wrote is none of the government's goddamn business.

the problem when you defame Islam is that some lunatics put a price on your head and detonate explosives on your front door. you don't see this happening when you defame christianity (except perhaps in jesusland, of course).

che, nice generalisation right there my stalinist friend. According TO ME it's not to be condemned. Christian religion is fair game, so is any other religion. Everyone has the right to be offended by them speeches though and they can raise their voice. I don't know what is happneing in Italy now, seems like the terrorist lovers has strong lobby.
