Okay, we're in a so-called War on Terrorism, whidch essentially translates to "War on Dark People CLXIV." Basically people more or less realize that Terrorism isn't some shadowy thing with an organization that we can send James Bond and his Yankee equivalent to empty a can of whup ass on while screwing really hot chick. Terrorism is a method of waging war. The people who are using terrorism as a method of waging war are the Middle Easterners and South Asians. These are the people - like it or not, Imran, it's the truth - who we are fighting. It makes no sense to stretch out security to include people who are not likely threats. The people who should be checked are the ones who are most likely to cause us harm - that way we can hopefully do a decent job of interdicting the attacks.

Oh, and Ned: here's the best proof of all:

When they caught that guy who was planning to blow up a building in LA at the Canada-US border, the newspapers here ran it as a front page story for a week, and there are still innumerable references to the incident every time there's a story about terrorism at home. There's never been a single mention of a Sept. 11 hijacker having Canadian ties. The best they could come up with was that a few money trails came through Canada, as was the case for every other Western country.

Mr. O'Reilly's not very impressive as a journalist, and his audience isn't very impressive in collective brainpower. I'm still astounded that he would say something this completely, factually, wrong, so I suspect that you're mistaken in your reporting of his words

The same principle applies to student visa's which is one of the holes they're trying to plug. The problem is visitor visa's. Virtually anyone can enter the USA with a visitors visa then disappear. In order for there to be any control over who enters the US there has to be electronic surveillance of everyone (fingerprinting and/or face recognition) at all major entry points (you cant cover them all).

KN, I'll drop the issue of the 9/11 hijackers for the moment. Why don't you address the substance of my posts for a second. The nut of what I said is that tightening security at US airports makes no sense if terrorists can enter Canada as refugees with no papers as all, obtain Canadian papers and merely drive across the border.

The Consitution is, among other things, a set of limitations on the conduct of the government. The government is limited in its conduct regardless of with whomever it is dealing. The SCUSA has repeatedly held that the Constitution applies to foreign nationals residing within the US.

Wrong again, some protections of the constitution apply only to citizens, some apply to residents (with some gray area between legal and illegal residents), some (a small amount) apply to all persons.

Cris, Assume for the moment we are at war with France. Can't we legally cut off visa's from France? Can't we legally cut off visa's for French citizens no matter where they came from? How would this be discrimination against US citizens of French descent?

Be that as it may, we are talking about "temorary" non-resident aliens in the United States. Surely we can provide laws that require the aliens to keep the US Govt. informed of their whereabouts. I believe that law already exists. I believe the US Govt. has the further right to track the current location and status of such "temporary" non resident aliens.

But now the question gets down to fingerprints. We want to fingerprint only selected non resident aliens. Can we do this lawfully?

I say yes - because there is a compelling need to do so.

This does not, however, translate into discrimination in any manner shape or form with respect to any resident aliens or citizens. The discrimination is limited to non resident aliens, and is based on a compelling Govt. need.
