Help yourself to an AD-FREE life

Just a story I came across Enforcing border laws will save lives
> By Elton Gallegly
> On March 29, Los Angeles County sheriff's Deputy David March was shot
> repeatedly during a routine traffic stop in the quiet suburb of Irwindale.
> Shortly thereafter, he was pronounced dead at Huntington Memorial Hospital
> in Pasadena.
> The victim was a highly respected seven-year veteran of the Los Angeles
> County Sheriff's Department who lived in Santa Clarita with his wife and
> stepdaughter.
> This was a senseless, cowardly act. The suspected killer, 25-year-old
> Armando Garcia, fired without warning and for no apparent reason.
> Garcia has a criminal history involving narcotics and weapons violations
> (as well as being a suspect in two attempted murders). He is also an
> illegal alien who the Immigration and Naturalization Service had sent back
> to his native country on three separate occasions. Each time he returned
> to the United States to continue his life of crime.
> Tragically, this cold-blooded killing could have been avoided had the
> federal government been serious about enforcing our nation's immigration
> laws. Despite his criminal background and deportations, every time Garcia
> was arrested, our federal government -- through the U.S. Attorney's Office
> in Los Angeles -- failed to prosecute him for illegal re-entry.
> The law is very clear on this issue: A criminal alien who re-enters the
> United States after deportation can face up to 20 years in jail.
> If the U.S. attorney does not prosecute violent felons who are deported
> and subsequently re-enter, it makes a mockery of our immigration laws.
> Criminal aliens who prey on our citizens fear deportation only if
> deportation carries a price. And that price is prosecution and long
> imprisonment if they sneak back across the border.
> Otherwise, all the laws and all the statements about how tough we are on
> criminal aliens are meaningless.
> The slaying of Deputy March is a case in point. Garcia, after being
> apprehended for illegally entering the United States, was "voluntarily"
> returned to Mexico by the INS in 1992. It is not clear whether he actually
> left the country.
> In 1994, following a conviction for narcotics trafficking, Garcia was
> again taken into INS custody. This time he was formally deported.
> Again, Garcia re-entered and in 2000 committed yet another crime. At this
> point, the U.S. attorney had the opportunity to prosecute Garcia for
> illegal re-entry following deportation. If he had been convicted, Garcia
> would have been eligible for at least a 10-year prison term. He would
> still be behind bars today.
> However, the Los Angeles U.S. Attorney's Office declined to prosecute
> Garcia. Unfortunately, this is not an isolated case of going easy on
> criminal aliens.
> Back in 1998, I wrote to then-Attorney General Janet Reno to urge more
> prosecutions of these crimes. I even attached a list of 577 criminals who
> were not prosecuted after being deported by the INS and returning to
> California.
> The reply I received assured me that the Department of Justice was
> aggressively enforcing provisions dealing with deported criminal aliens,
> especially if the underlying crime was a felony.
> Despite these assurances, I learned later that each U.S. Attorney's Office
> has a different policy for prosecuting criminal aliens who re-enter the
> United States. When Reno was attorney general, the Los Angeles office set
> a much higher benchmark for prosecution than is called for by the law. The
> result is that our federal prosecutors are allowing far too many deported
> criminals loose in our communities.
> This failure has terrible consequences, which brings us back to the
> slaying of Deputy March. He was killed by somebody who should have been in
> a federal penitentiary instead of on the streets. Garcia had already been
> convicted of two felonies when he was arrested in 2000. And he had been
> deported by the INS back in 1994.
> Under any reasonable enforcement policy, he should have faced serious jail
> time for illegal re-entry. Instead, Garcia was again sent back to Mexico.
> He returned to the Los Angeles area and a law enforcement officer, a
> husband and parent, was killed.
> The laws are already in place and, in most cases, the penalties are
> sufficient. What is missing is a willingness to enforce the laws on the
> part of the U.S. Attorney's Office. Before we have more tragedies, it is
> time for them to do so.

Even when we catch a crook we donot put them in jail.

This all makes no sense if Canada does not cooperate. Allowing undocumented aliens free entry into Canada while our border remains as open as it is defeats any attempt to tighten security with respect to aliens flying directly to American cities.

If Canada doesn't fix things and history repeats itself (15 of the 19 9/11 hijackers entered from Canada) we may have no choice but to take Canada over. Is there a simpler solution?

It's not the legalisms that everybody should be focused on, rather the politics. The American people just aren't in a mood for discriminatory behavior over the long haul. Doesn't matter whether the guests are Arab, Chinese, or 4-legged Martian. Doesn't matter whether they are citizens or non-citizens.

It's all grates against the notion of fair play. A couple of months ago, I read an article about a Pakistani immigrant who had won a greencard lottery. Delivering pizzas in the godforsaken town of Buffalo (probably like most Canadian cities). Anyways, he was detained and deported for arranging for housing for an immigrant family that didn't have papers. Nearly broke my heart, even though I am hard-hearted.

Whoa, that was pretentious, too...

So what is stopping Muslim extremist terrorist groups, if this becomes policy, from just having non-Arabs who don't fit the profile be their attackers? Doesn't seem to hard to get around it.

Basically. We've got more liberal immigration and refugee policies, so a lot of people try the US, are rejected and then come to us for succor. Apparently the new agreement will stop that. I find it hilarious that Ned feels there's a problem with people landing here and then trickling down south when things are the other way 'round.

I still think pretentious fits better:

pre-ten-tious (adj.) - 1 making claims, explicit or implicit, to some distinction, importance, dignity or excellence. 2 affectedly grand, ostentatious.

Whereas presumptious means being too bold or forward, taking too much for granted.

Now who's Mr. Malapropism, beyaaaatch!

Bzzzz! Nope, doesn't work...it is meant as in taking upon one's self to do something beyond the realm of one's ordinary duties or overstepping the bounds of societal propriety.

You clearly meant he was being pretentious, as he is implying some sort of wisdom or grandeur by using an avatar of Gandalf.

Thanks for playing.

Would it be better if we simply sharply reduced the number of Visas given to people originating in Muslim countries? Perhaps we could limit permission to enter the US from those countries to people who can prove that they have a bone fide business reason to enter the US. Since it takes two to do business they would have to supply confirmation form a source within the US.

"Would it be better if we simply sharply reduced the number of Visas given to people originating in Muslim countries?"

I don't think it would hold over time, Strangelove. Would you refuse visas for vacationers from Saudi Arabia? If so, how would you compensate the Northern Virginia upscale boutiques?

As a legal matter, we could probably do what we like.

I heard the data about the 15 hijackers coming from Canada on the Bill O'Reilly show. The articles cited by KH do not dispute this. They merely state that the hijackers did not "sneak" into the U.S. across the Canadian border.

The problem with Canada according to O'Reilly is that Canada gives refuge to undocumented aliens seeking refuge. Since 9/11, at least 2500 came from Arab or Muslim countries.

If the US seriously clamps down on visitors from these countries, the terrorist will simply go to Canada, get Canadian documents, rent a car, and drive into the U.S. KH, if you don't think this will happen, tell us why.

And I really wish you would stop it with your ad hominem attacks.

No, just regulate immigration and visitation from Muslim countries more tightly. Basically you only let in the rich from those countries. Yes, this legally can be done because the Supreme court has repeatedly asserted that it has no juisdiction over immigration policy. Perhaps in the face of this sugggestion fingerprinting doesn't sound so bad.
