The same could apply here possibly but as I said there won't be a problem probably. Everything that could increase sales instead of decreasing them, nomatter if it would violate copyright and trademarks should not rise legal actions. But we should be aware that using the name "Call To Power" and any graphic, modified or unmodified from the original CD could be subject to copyright issues.

I would hope that all of this stuff falls under "New Game Materials", upon the distribution of which the EULA places several restrictions: not a stand-alone product, not illegally exporting, not for profit and most importantly:
quote: · New Game Materials must not contain any illegal, obscene or defamatory materials, materials that infringe rights of privacy and publicity of third parties or (without appropriate irrevocable licenses granted specifically for that purpose) any trademarks, copyright-protected works or other properties of third parties. |
It specifically says trademarks, copyright-protected of third parties, so distributing Activisions should be OK.
|
In the first paragraph the EULA specifies what should be bound to the EULA:
quote:
IMPORTANT - READ CAREFULLY: USE OF THE CALL TO POWER II SOURCE CODE IS SUBJECT TO THE SOURCE CODE SOFTWARE END USER LICENSE AGREEMENT TERMS SET FORTH BELOW. “CALL TO POWER II SOURCE CODE” INCLUDES THE SOFTWARE INCLUDED WITH THIS AGREEMENT, THE ASSOCIATED MEDIA, ANY PRINTED MATERIALS, AND ANY ON-LINE OR ELECTRONIC DOCUMENTATION, AND ANY AND ALL COPIES OF SUCH SOFTWARE AND MATERIALS. BY INSTALLING, AND/OR USING THE CALL TO POWER II SOURCE CODE, YOU ACCEPT THE TERMS OF THIS LICENSE WITH ACTIVISION PUBLISHING, INC. (“ACTIVISION”).

There is no reference to the name of the game "Call To Power". Unless of cource the name is included in the printed materials and electronic documentation, and the graphics in the associated media.
They always do licence agreement so criptic

True - there's enough of us with Photoshop etc to make new graphics where needed. I dont like the idea of nicking other people's work either - still if it came with CTP2 it should be ok under the agreement to modify it, as long as it will always need the origional CD to play from.

Maybe a bit more, (haven't got an example) so that there is more '3D'-depth and the 'borders' looking more burned.

I like it as it is - excellent work for something aparently knocked up in short order! I'm impressed
Now if its possible - would you be able to add a 'load Mod' button to the vacant button space on the right? Is this a good idea? I'm just thinking for newbies the whole using Modswapper(which has been an excellent utility) thing could be removed with a direct button on the menu screen? thoughts?
